Frequently Asked Questions (FAQ)
Is it legal for an LLC to work with a private entrepreneur on the 2nd group of the single tax?
Mostly no: a 2nd-group entrepreneur may only provide services to individuals and single-tax payers, so a service agreement with an LLC on the general tax system violates the conditions of the group and creates tax risks for both parties. Check such transactions with a consultant before signing.
Is a bank account mandatory when registering a non-governmental organization?
Without an account an NGO effectively cannot operate — receive contributions and grants or pay for services. The account is therefore opened right after registration, and at that stage it is worth deciding who will keep the organization’s books.
Is salary kept for a mobilized employee?
No. Since 19 July 2022 the obligation to pay mobilized employees their average salary has been abolished (Law No. 2352-IX): no salary is accrued, as the employee does not actually perform their duties. At the same time, their job and position are retained (Art. 119 of the Labour Code).
What should HR do if an employee is mobilized?
Confirm the fact of mobilization and collect the necessary documents, issue an order releasing the employee from work while retaining their job and position, and correctly keep time records for the whole period of service.
Is two weeks’ notice required when resigning under martial law?
As a general rule — yes, but martial law added an exception: an employee may resign without the two-week notice period if there is a risk to their life or health. In other cases the standard procedure applies, with proper paperwork and full settlement on the last working day.
Can a non-profit organization be a VAT payer?
Yes. Non-profit status does not automatically exempt from VAT: for example, when purchasing services from non-residents the place of supply is Ukraine, and such transactions are subject to VAT. NGOs should analyse specific transactions rather than rely on their status alone.
Who is liable if an error is found in the books?
If UHY Prostir keeps your books under a comprehensive service agreement, we bear contractual liability for the result: professional liability is insured for UAH 10 million, so the financial consequences of an error are covered by insurance, not by the client’s budget.
